Terms of Use

By creating an account or using Funkshin, you agree to these Terms.
1. About Funkshin
Funkshin is an AI automation and agent orchestration platform that helps users build, deploy, coordinate, and monitor AI-powered workflows. In these Terms, "Funkshin," "we," "us," and "our" refer to the operator of the Funkshin service. "You" refers to the person or organization using the service.
2. Eligibility and acceptance
You may use Funkshin only if you can legally enter into a binding agreement and are not prohibited from using the service under applicable law. If you use Funkshin for an organization, you represent that you have authority to bind that organization.
These Terms, together with any order, plan details, and policies expressly incorporated into them, govern your use of Funkshin. If you do not agree, do not create an account or use the service.
3. Accounts and security
You are responsible for providing accurate account information, protecting your credentials and access tokens, and all activity occurring under your account. Do not share credentials or tokens outside the people and systems authorized to use them.
Notify us promptly if you believe your account or token has been compromised. We may require identity or ownership verification and may suspend access while investigating suspected unauthorized activity.
4. The service
Subject to these Terms and your selected plan, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use Funkshin for your internal business or personal purposes. Funkshin may include shared hosting, dedicated virtual machines, AI agents, workflows, storage, integrations, logs, and usage-based model services.
We may modify, improve, replace, or discontinue features. We will use reasonable efforts to provide advance notice of material changes that substantially reduce the service, except where changes are needed for security, legal compliance, or prevention of abuse.
5. Your content and instructions
You retain your rights in text, files, data, instructions, credentials, and other material you submit to Funkshin ("Your Content"). You grant us the limited rights needed to host, process, transmit, display, back up, and otherwise provide the service to you.
You are responsible for Your Content, the workflows you configure, the actions your agents take, and the permissions you grant to integrations. You represent that you have all rights and permissions necessary for us to process Your Content and for your use of the resulting workflows.
Do not submit sensitive personal data, regulated data, or confidential information unless your plan and configuration are appropriate for that data and you have obtained all required permissions and notices.
6. AI outputs and human oversight
AI systems can produce inaccurate, incomplete, biased, or misleading results. Outputs may not be unique and are not guaranteed to be correct, current, lawful, or fit for a particular purpose. You must review outputs before relying on them or allowing them to trigger consequential actions.
Funkshin is not a substitute for professional legal, medical, financial, security, or other expert advice. You are responsible for decisions made using the service and for implementing appropriate human review, testing, approval, and monitoring.
7. Acceptable use
You must not use Funkshin to:
- Break the law, infringe rights, or violate another person's privacy.
- Harass, threaten, exploit, defraud, impersonate, or harm others.
- Generate or distribute malware, spam, phishing, unauthorized surveillance, or harmful automated activity.
- Process information without the required consent or legal basis.
- Attempt to bypass authentication, access another account, probe or disrupt systems, or interfere with service availability.
- Reverse engineer, resell, scrape, or copy the service except where applicable law expressly permits it.
- Use the service in a high-risk decision or safety-critical setting without appropriate safeguards and human review.
We may remove content, disable workflows, revoke tokens, or suspend accounts where we reasonably believe these rules or the security of the service are at risk.
8. Third-party services
Funkshin may connect to Netcup infrastructure, OpenRouter, direct AI model providers, customer-owned inference servers, APIs, and other services. Your use of those services is subject to their terms and policies. We are not responsible for third-party availability, content, pricing, security, or changes. You authorize Funkshin to exchange data with an integration only as configured by you.
Model routing can send prompts, files, instructions, metadata, and outputs to OpenRouter or a direct provider. You are responsible for selecting an appropriate route and provider for your data. The current provider categories are described in the Subprocessor List.
9. Plans, fees, and payment
Paid features and infrastructure are billed according to the plan or order shown at purchase. Dedicated virtual-machine prices are charged separately from usage-based model costs unless expressly stated otherwise. Model usage is calculated using the selected model's applicable input and output token rates, together with Funkshin's variable platform margin.
Funkshin's platform margin is not a fixed percentage for all customers. It may vary by usage volume, model, route, plan, or other pricing factors and is intended to decrease at higher monthly token volumes as described on the applicable pricing page. The provider's model price and Funkshin's platform margin may change, and the price shown before purchase or in the account is the applicable price for the relevant billing period. Prices may exclude taxes and third-party charges where applicable.
You authorize the applicable payment provider to charge recurring fees where your plan renews automatically. You may cancel a paid plan through the available account controls or by contacting us. Unless required by law or expressly stated at purchase, fees already paid are non-refundable and cancellation takes effect at the end of the current billing period. We may suspend paid services for overdue amounts after reasonable notice.
10. Intellectual property
Funkshin and its software, interfaces, documentation, branding, and underlying technology are owned by us or our licensors. Except for the limited right granted in these Terms, no rights are transferred to you. You may provide suggestions or feedback, and we may use them without restriction or compensation.
11. Confidentiality and privacy
Each party will use reasonable care to protect non-public information received from the other party and use it only for the relationship. This obligation does not apply to information that is public, independently developed, rightfully received from another source, or required to be disclosed by law.
Our Privacy Policy explains how we collect and use personal information. For customer workspace data that is personal data, our Data Processing Agreement applies. Where the GDPR or another data-protection law applies, you must not instruct Funkshin to process data unlawfully or submit special-category data without an appropriate legal basis and written authorization.
12. Suspension and termination
You may stop using Funkshin at any time. We may suspend or terminate access for material breach, nonpayment, legal requirements, security risks, abuse, or if continued operation would create unreasonable risk. Where practical, we will provide notice and an opportunity to resolve the issue.
After termination, your right to use the service ends. We may delete account data according to our retention practices and legal obligations. Sections that by their nature should survive termination will continue to apply.
13. Disclaimers
To the maximum extent permitted by law, Funkshin is provided "as is" and "as available." We disclaim warranties of availability, uninterrupted operation, accuracy, merchantability, fitness for a particular purpose, non-infringement, and any guarantee that the service or outputs will meet your requirements or produce a particular result.
14. Limitation of liability
To the maximum extent permitted by law, Funkshin and its officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption.
To the maximum extent permitted by law, our total liability for claims arising from the service or these Terms will not exceed the greater of the fees you paid to us for the service during the three months before the event giving rise to the claim or EUR 100. Nothing in these Terms limits liability that cannot legally be limited.
15. Indemnification
You will defend and indemnify Funkshin from claims, losses, liabilities, and reasonable costs arising from Your Content, your workflows or integrations, your breach of these Terms, or your violation of law or another person's rights, except to the extent caused by our own willful misconduct.
16. Changes and general terms
We may update these Terms from time to time. We will post the updated version and change the "Last updated" date. Material changes will be communicated through the service or another reasonable method. Continued use after the effective date means you accept the updated Terms.
These Terms are the entire agreement about Funkshin and replace prior agreements about the service. You may not assign them without our consent. If a provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver.
